Lempart Flex Terms of Service 1. Who we are Lempart Flex is a mobile connectivity service operated by Lempart Communications (a business operated by Vasyl Banuliak), New York, NY, United States. Contact: support@lempart.app. These terms are the agreement between you and us when you use the Lempart Flex app or website and buy a plan. 2. What we sell Prepaid eSIM plans for use in the destinations listed on each plan. A plan gives you a stated amount of mobile data (and, only where a plan says so, calls, SMS or a phone number) for a stated number of days. Plans marked "Unlimited" have no data cap but run at full speed only up to the fair-use amount shown on the plan (for example, 1 GB each day); above that, speed is reduced as stated. We do not operate mobile networks ourselves: plans run on the networks of local operators in each destination. 3. What you need Your phone must support eSIM and must not be locked to a carrier. We cannot check either from the app, so please check before you buy (on iPhone: Settings → General → About → Carrier Lock should say "No SIM restrictions"). You must be at least 18 years old, or have a parent's or guardian's permission, to buy. 4. Ordering and prices The price you see before you pay is the price you pay, in US dollars unless shown otherwise. Card payments are processed by our payment provider; we never see or store your card number. An order is complete when the eSIM has been issued to you. If we cannot issue the eSIM, we cancel the order and release or refund the payment in full. 5. Installation An eSIM installs once, on one phone. Do not delete it: a deleted eSIM cannot be reinstalled, and a plan on a deleted eSIM is not refundable. The plan must be installed within the period stated on the plan (usually 180 days from purchase). 6. Start and validity Each plan says when its clock starts — normally when the eSIM first connects to a network in its coverage area, so you can install it before you travel. Validity is counted in days from that start and ends at the same time of day on the last day. Unused data does not carry over and is not refunded. 7. Coverage, speed and fair use Coverage, speeds and network technology (3G/4G/5G) depend on the local operators and on your phone, and can vary by place, time and load. Speed caps and fair-use rules are shown on each plan before you buy. Plans are for personal use in a normal way; see the Acceptable Use rules. 8. Refunds A plan is refunded in full on request as long as the eSIM has not been installed. Once the eSIM is installed, or once any data has been used, the plan is not refundable — except when the eSIM could not be activated in its coverage area through no fault of yours, in which case we refund in full. Full details are in the Refund and Withdrawal Policy. 9. Support Write to support@lempart.app with your order number. We answer by email and inside the app. If your eSIM does not work, contact us before your trip ends so we can help while it matters. 10. Your account You can buy as a guest or sign in with Apple or Google. Your orders and eSIMs are shown in the app on the phone that bought them and, when you are signed in, on any phone where you sign in. Keep your sign-in secure; you are responsible for purchases made through it. 11. Our responsibility We supply the plan with reasonable care and skill. We are not responsible for a phone that is locked or not eSIM-capable, for an eSIM you deleted, for networks that are out of our control, or for losses you could have avoided by contacting us. To the extent permitted by law, our total liability for a plan is limited to the price you paid for it. Nothing in these terms limits liability that cannot be limited by law, including your statutory consumer rights. 12. Changes We may update these terms for future purchases. The version you accepted at checkout governs that purchase; the current version is always available in the app and at https://lempart.app. 13. Governing law and disputes These terms are governed by the laws of the State of New York, United States. If we have a dispute, please contact us first — most problems are solved within a few days. Where the law allows, disputes are resolved by the courts of NY. If you are a consumer, you keep any protection of the law of the place where you live. Effective: on publication.
